We have continued to enforce the Tobacco Hazards Prevention Act by conducting inspections, providing educational programs on tobacco hazards prevention for specific groups, bolstering advocacy efforts, expanding the network of smoking cessation services, and promoting tobacco hazards prevention initiatives in communities. These methods encourage people to comply with the Tobacco Hazards Prevention Act to achieve a more comprehensive smoke-free environment.
(1) Procactive enforcement, inspection and guidance
County and city health bureaus have taken the initiative in enforcing the act and in conducting inspections and offering guidance reflecting inspection results. In 2023, more than 630,000 entities were inspected nationwide, totaling over 6.58 million inspections. A total of 6,470 penalties were imposed, resulting in fines amounting to over NT$67.55 million. Fines imposed for 735 cases violating the provisions of Imitation tobacco products and designated tobacco products set forth in Article 15 of the Tobacco Hazards Prevention Act exceeded NT$44.93 million.
(2) Training for raising professionalism in tobacco hazards prevention
The HPA has improved the quality of tobacco prevention work by organizing workshops, seminars, and training sessions, as well as compiling guidelines for law enforcement. Additionally, education and training is provided for tobacco hazards prevention volunteers.
(3) Tobacco Hazards Complaints Hotline: Working together to protect all
The HPA operates a “Tobacco Hazards Complaints Hotline” at 0800-531-531 to address public inquiries and reports related to the Tobacco Hazards Prevention Act. Cases involving illegal activities were referred to county and city health bureaus for investigation and carry out enforcement in accordance with the law and regulations.
(4) Active promotion of the amendment of related laws to build a tobacco-free environment
The amendment of Tobacco Hazards Prevention Act passed the third reading in the Legislative Yuan on January 12, 2023, promulgated by President on February 15, 2023 and the effective date was March 22, 2023. The amendment consists of the following key points:
i. Banning all kinds of imitation tobacco products, including electronic cigarettes.
ii. Designated tobacco products shall be applied to the central competent authority for the health risk assessment review (e.g. heated tobacco products).
iii. The health warning graphic and text labels on tobacco packaging increase from 35% to 50%.
iv. Tobacco products shall not contain prohibited additives announced by the central competent authority.
v. Raising the legal smoking age from 18 to 20.
vi. Expanding non-smoking places: Universities, kindergartens, childcare centers and family childcare facilities are completely non-smoking; bars and nightclubs are also prohibited for smoking, except in separate smoking rooms.
